O-1B Visa Artists & Entertainment : How can artist work in the US?, Immigration Lawyer in California


Did you know that at the two artists can get
a visa to work in America? Stay tuned and watch how. Hi everybody. My name is Jacob Sapochnick and I’m an immigration
attorney based in San Diego, California. In this video, I’m going to talk about how
at the two artists or any other artists for that matter can get a work visa to work and
live in the United States. This visa is called the O-1B. I liked the O-1A that I’ve done videos before. The O-1B is reserved for those that have extraordinary
ability of the arts to come in and working in the United States. So this visa requires the following. Number one, it has to show that you have achieved
a certain level in your field. So, if you are the two artists that you have
gained fame and exposure in your field, how do we show this? We show this by articles and publications
about you. We showed this by prizes and awards that you’ve
earned in your field. We sure this by the fact that you earned a
high salary or something like that in your field. We can also just show this that you have been
a judge or in a competition in your field. So for example, at the two competition or
something like that. We can also show this by peer letters or people
that are known in the industry, maybe models that are in the space and they can write about
doing things like that. Now, remember we, we only need to show three
criteria out of 10 in the O-1B category. So we don’t need to show all of it. And if, for example, we had a case with some
new with the tattoo artist and came to me and we only had two criteria out of the town. He didn’t have three, which I need. And I said, ‘Listen, why don’t you try gain,
some judging a roles in competition. There’re so many competitions inside or outside
of the U.S. Why don’t you try it again those.’ I mean, you know, he came back to me a few
months later after being a judge at some of these competitions in his tattoo field and
I was able to used that including other articles to build a stronger case and his got his own
O-1B case and now we’re planning to do his green card using those categories. Remember, O-1B is an artist visa, reserve
for artist in several categories including tattoo, including painters, including…even
social media influencers, they have an entire, huge Instagram following and they are showing
their pictures and an artist on their accounts that can get O-1B visas. We’ve done this before. Again, remember we have to show at least three
out of 10 categories. So high salary articles that is from peers,
judging competition and things like that. And if we have those, we put us in a strong
case, we file this and you can get an O-1B visa for the duration of your contract. You need to sponsor or an agent to be able
to do that. Somebody who’s going to offer you a job or
be your agent representing you in that particular field. And again, the visa is issued for the duration
of your contract. You have to show why you come in here. But it’s an amazing visa for artists to come
to the United States to build themselves and move forward and get a green card, which is
also possible after you get an O-1B. So remember, if you’re interested in the O-1B,

    Hey, I’m a tattooer in London I have a trip planned to New York for the end of the year so I need a Visa. I have a fairly large Instagram following and bookings already taken and a shop to host me but I don’t know if this visa will work for me?

    Hi, I'm a Chilean Actor, 29 years-old, investigating the O1B… I've been working in my field, I have not won awards but I've worked in 3 soap operas in a succesfull Tv Channel (I've collected some interviews, news, publications about my roles, etc.), and before I've had participation in some Tv Series, doing theater, etc. Could I apply for this Visa? And the other question is…. Are there companies that hire o1b visas? I want to get to LA and it is necessary to have a first job that allows me to pay the rent, expenses, etc. Thank you!!!! A Hug
