Applying for H-1B Visas for 2014

Hi, my name is Michael Niren. I’m an immigration
lawyer and founder of I’m here to discuss H-1B
visas. On April 1, 2014, the government will be accepting
H-1B applications once again. There’s an annual cap of 65,000 H-1Bs
that will be accepted for the calendar year, starting April 1, 2014.
For those who are applying for H-1B visas, you have to qualify. Basically
you have to have what is called a specialty occupation, you have to have a
job offer from a US company, and generally speaking, you should have a
college degree, but that’s not always the case. It really depends on the
circumstances. If you have some solid experience that is equivalent to a
college degree, or a university degree, you may qualify for an H-1B.
The important thing to know is that in 2013, within a matter of days, the
cap was reached. So this means that there’s going to be a mad rush, come
April 1st, when people are going to be submitting those applications. So
it’s very important to prepare well in advance, so by the time April 1st
comes, you will be in a good position to apply right away. Because if you
apply too late, you may find yourself automatically disqualified.
For those that do qualify, and get approved, then you can start working
October of that year. So, the way it works is that, even if you get your
approval before, let’s say, after you submit your application and you get
your approval before October, you can’t work until that date. However, the
key is to file the application as soon as possible.
So the big message I’m trying to give people, is to prepare in advance, if
you had a job offer in the US, and your employer in the US wishes to
petition for you. Make sure that you start the paperwork as soon as
